The terms of this agreement (“Terms and Conditions”) govern the relationship between you and Vodacom and its affiliates (hereinafter “Vodacom” or “Us” or “We”) regarding your use of Vodacom’s Soccer Service and related features (the “Service”). Use of the Service is also governed by Vodacom’s Privacy Policy which is incorporated herein by reference.

  1. Your Acceptance of these Terms and Conditions

    1. Vodacom is the provider of the Vodacom Soccer Service (the “Service”), in its various formats accessible via mobile devices. Please read these Terms and Conditions and the Privacy Policy carefully before using the Service or submitting information through the Service. By using the Service or submitting information through the Service, you are agreeing to these Terms and Conditions. If you do not agree, please do not use this Service or submit any information through the Service. We recommend that you print a copy of these Terms and Conditions and the associated Privacy Policy for your records. We reserve the right, at any time, to modify and update these Terms and Conditions from time to time by posting such updated Terms and Conditions on the Vodacom website, the Soccer Service mobi site, and the Application, so please check back periodically. Any such updates shall apply to you and your use of the Service and by continuing to use the Service, you shall be deemed to have accepted such changes.

  1. General

    1. We grant you permission to use the Service, in accordance with these Terms and Conditions, provided that: (i) your use of the Services is only for your personal, non-commercial purposes; (ii) you do not copy or distribute any part of the Service in any medium without our prior written authorization; (iii) you do not alter or modify any part of the Services other than as may occur during your proper use of the Service for their intended purpose; and (iv) you comply with these Terms and Conditions.

    2. We reserve the right, in our sole discretion, to restrict, suspend or terminate your access to all or any part of the Service at any time for any reason on prior notice to you and without any liability to you for doing so. We may change, suspend or discontinue all or any aspect of the Service at any time, including the availability of any specific features or content.

    3. We do not permit copyright infringing activities or the infringement of intellectual property or other proprietary rights (including privacy and publicity rights) in connection with the Service, and we will remove all content and user submissions if properly notified that such materials infringe on a party’s intellectual property right . You agree that you will not submit any material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant us all of the license rights referred to in these Terms and Conditions. Accordingly, you affirm, represent and warrant that: (i) any materials you submit are wholly original to you, or to the extent they are not wholly original to you that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all of your submissions to enable inclusion and use of them in the manner contemplated by the Services and these Terms and Conditions; (ii) no payment, royalty or consent is required in connection with the rights granted to us in these Terms and Conditions; and (iii) you have the written consent, release, and/or permission of each and every identifiable individual person in the submission to use the name and/or likeness of each and every such identifiable individual person to enable inclusion and use of the submissions in the manner contemplated by the Service and these Terms and Conditions. We reserve the right to remove materials without prior notice and also to terminate your account and/or access to the Service if we believe that repeated violations of this section have occurred.

    4. The Service is made available via the relevant formats accessible via a mobile device. These include, but are not limited to, a USSD (Unstructured Supplementary Services Data) portal made available exclusively to mobile devices which are technically able to access the relevant USSD string; a mobi site accessible via a standard mobile device Internet browser application; a mobile web application accessible via a standard mobile device Internet browser application; an operating system based mobile application that can be downloaded and installed to a mobile device, and a text alert service whereby texts are pro-actively pushed to the mobile device based on relevant parameters as described below.

    5. We hereby grant you a personal, non-exclusive, non-transferable, limited license to install and/or access the Service / mobile applications solely on the devices you will use to access the Service for your own non-commercial, information or entertainment purposes. You may not: (i) modify, disassemble, edit, decompile, reverse engineer or copy any Service / mobile applications; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer any Service / mobile applications to any third party or use any Service / mobile applications to provide time sharing or similar services for any third party; (iii) remove, circumvent, disable, damage or otherwise interfere with security-related features of any Service / mobile applications, features that prevent or restrict use or copying of any content accessible through the Mobile Applications, or features that enforce limitations on use of the Service / mobile applications; or (iv) delete the copyright and other proprietary rights notices on the Service / mobile applications.

    6. You acknowledge that we may from time to time issue upgraded versions of the Service and these will be incorporated automatically for any versions of the service that are not downloaded to your device (e.g. USSD, mobi site, mobile web app). You acknowledge that we may from time to time issue upgraded versions of the downloadable applications, where we will prompt you to download and install the updated version of the Service. You consent to such upgrading of the Service, and agree that these Terms and Conditions will apply to all such upgrades. Normal data charges as per your tariff price plan will apply for such upgrades when downloading the updated application. Should you not wish to incur such charges, you are advised to discontinue your use of the Service. You acknowledge that from time to time, the Service’s availability may be limited due to maintenance, upgrade or other technical reasons as relevant.

    7. We do not warrant that any mobile application will be compatible with your mobile device. Any third-party code that may be incorporated in any mobile application is covered by the applicable open source or third-party license EULA, if any, authorizing use of such code. We or our third party partners or suppliers retain all right, title, and interest in the mobile applications (and any copies thereof), and any intellectual property rights therein. Unless otherwise specified, standard carrier data charges may apply to your use of the mobile applications.

    8. Vodacom reserves the right to stop offering and/or supporting the Service or a particular part of the Service at any time, at which point your license to use the Service or a part thereof will be automatically terminated. In such event, Vodacom shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Services, or any discontinued parts thereof.

    9. To the extent allowed by law, the Service is provided on an “as is” and “as available” basis for your use, without warranties of any kind, express or implied. Vodacom does not warrant that you will be able to access or use the service at the times or locations of your choosing; that the service will be uninterrupted or error-free; or that defects will be corrected.

    10. You acknowledge that Vodacom may appoint third party companies and individuals to facilitate the Service (e.g. maintenance, analysis, audit, marketing and development). These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to Vodacom not to disclose or use it for other purposes.

    11. You acknowledge that certain aspects of the Service including browsing on the USSD platform, as well as certain text alerts and rewards are currently provided for free to Vodacom customers, though this is subject to change at any time at Vodacom’s discretion. Any change in this respect will be communicated to you with at least 1 (one) month’s notice via applicable means, including but not limited to, the sending of a standard text message to your device to inform you of any applicable change.

    12. You acknowledge that you are aware that your carrier's normal data rates and fees as per your tariff price plan will still apply when using the Service via the mobi site accessible via your mobile device Internet browser application, or the downloadable applications, or any other application offered on any other platform or operating system should Vodacom choose to offer it. This includes the downloading of the application (and any updated versions thereof) to your device and the updating of the application’s content in its normal use.

    13. If you are a non-Vodacom subscriber, you acknowledge that some of the platforms may not be accessible to you as far as your mobile device and connectivity enables. Vodacom reserves the right to offer the Service exclusively to Vodacom subscribers on any Vodacom proprietary platforms. You accept that in some cases, should you wish to access / use the Service, you may need to become a qualifying Vodacom subscriber to do so.

    14. If you are a non-Vodacom subscriber, you acknowledge that your entire use of the Service, including but not limited to, browsing, downloading and updating of the Service, accessed by any of the mechanisms provided, will be charged at standard rates as per your network’s current tariff price plan.

    15. The Service includes the provision of both factual and opinion based information and editorial content about international soccer, local South African soccer, and/or any other local / international tournaments which may occur and be covered by the Service from time to time. Vodacom or its appointed 3rd party maintains and owns the relevant licences and rights to display and provide such content via the Service. Neither Vodacom nor the 3 rd party appointed to provide this content may be held liable for any harm or consequences arising as a result of any unintended inaccuracies or discrepancies in the content.

    16. You acknowledge that the Service is an advertisement funded service which amongst other means, allows Vodacom to be able to provide the Service. As such, you acknowledge, whether registered or not, that you will be exposed to banner, text or other in-Service advertising and promotions media. Should you not wish to view such advertising while using the Service, please do not register and use the Service.

    17. Through the Service, we may occasionally offer you the opportunity to enter into contests, games and prize drawings subject to any further terms and conditions or contest rules. By entering into such contests and games, you agree to be bound by such additional terms, conditions and rules. In the event of a conflict between these Terms and Conditions and the specific rules of any such contest or games, the specific rules of such contest or games shall govern to the extent of the conflict.

    18. These Terms and Conditions apply to all users of the Service, including users who are also contributors of information, and other materials or services on the Services. The Services may contain third party advertisements, content, materials, and/or links to third party websites that are not owned or controlled by us. We assume no responsibility for, the content, privacy policies or practices of any third party websites. In addition, we do not and cannot censor or edit the content of any third party website. When you visit third party websites, we encourage you to read the terms and conditions and privacy policies of the other websites. By using our Services, you expressly release us from any and all liability arising from your use of any third party website or as a result of any third party presence on our Services.

  1. Additional provisions regarding Registered Users

    1. As a user of the Service, you will have the option to become a registered user (“Registered”), and doing so accordingly binds you to additional terms of use as referred to in these Terms and Conditions. As a Registered user, you will be asked to submit personal information to us. We are committed to ensuring responsible practices in the collection, use and disclosure of your personal information in accordance with applicable law. The terms and conditions of the Privacy Policy are incorporated by reference into and form a binding part of these Terms and Conditions. If you do not agree with our terms and Conditions please do not provide us with any personal information, and please do not register.

    2. By registering, you agree to the following additional rules:

      1. Only one registration is permitted per mobile number. Vodacom and non-Vodacom (where they have the technical ability to access the service) customers within the Republic of South Africa may register.

      2. You acknowledge that the Service has certain content which is locked and unavailable for access unless you register.

      3. You give us consent to provide you with various notifications and messages about / based on your interaction with the Service. These notifications will be delivered to you in the form of text messages, or in-application notifications sent to your mobile device using the mobile number identifying you as a user of the Service.

      4. These messages include, but are not limited to:

        1. periodic messages to encourage, remind or re-engage you to browse or access the Service;

        2. periodic messages to encourage, remind or re-engage you to select a team to follow via the text alerts provided by the Service;

        3. In the case of international soccer tournaments, periodic messages to encourage, remind or re-engage you to select a team to follow via the text alerts provided by the Service should your chosen team be eliminated from the tournament;

        4. messages inviting you to share, voluntarily, additional data about yourself or your preferences;

        5. messages inviting you to try alternate versions of the Service based on Vodacom’s knowledge of the device you are using to access the Service;

        6. confirmation messages relating to your registration or deregistration for the Service, and/or when you subscribe / unsubscribe to the text alert service;

        7. messages inviting you to rate the Service’s quality and your opinion of your experience of the Service as measured by the metric scale provided;

        8. messages relating to the earning, notification and servicing of rewards.

      5. You accept that the offering of some of the Service in a language of your choice is limited based on the content translations made available, and where availability does not exist, the default language for the service is English. Vodacom is not liable for any inconvenience arising from any content that is not available in the language chosen.

      6. By registering, you agree that you will be automatically subscribed to the basic proactive text alert service, which you may cancel at any time via the Service menu.

      7. Registered users may deregister (“quit”) at any time via the Service menu. When deregistering from the Service, you accept that your old profile and preferences will be retained for the duration of the respective local soccer season in effect, for the purpose of audit trail and to avoid abuse of the reward programme. You accept that should you attempt to re-register, you will retain your old preferences.

      8. You acknowledge that your registration details will be retained for use in future iterations of the Service, and that you will be engaged to continue using the Service as applicable for other soccer competitions intended to be covered by the Service. Should you not wish to participate or use future iterations of the Service, you may deregister at any time.

  1. Premium Services

    1. Registered users are given exclusive access to various premium services. Some of these involve the pushing of content to your phone via SMS on a once off or subscription basis. Others involve the unlocking of additional content on the Vodacom Soccer platform.

    2. All registered users are subscribed to basic alerts for free, though Vodacom reserves the right to change this at any time at their discretion. (Any changes will be communicated to registered users with reasonable notice and you will be afforded the option to unsubscribe.)

    3. Premium services carry a subscription charge, a once-off charge, or a related usage charge (e.g. the purchase of Kicks to play games) to any participating users. Depending on the service chosen, users are billed ad-hoc, daily or weekly, as per their own choice. Subscription and usage is voluntary and occurs via the Service menu. This charge is subject to change at Vodacom’s discretion. Any changes therein will be communicated to subscribed users with reasonable notice and you will be afforded the option to unsubscribe.

    4. Users will always be advised of the content fees payable for premium services and such users must first accept the cost prior to subscribing.

    5. To play the paid games on the Service, you will be required to convert your airtime into Kicks . You may only purchase Kicks from us via the Service, when using the service and the Kicks can only be used within the service. Once you convert your airtime into Kicks, you are granted a limited, personal, non-transferable licence to use the Kicks solely within the Service. When converting your airtime into Kicks to play any of the games, your Kick balance is retained until it is exhausted through use. Kicks, or payment thereof may not be reimbursed after purchase. The conversion of airtime into Kicks and use of Kicks through the Service are final and non-refundable. Kicks will not be reimbursed for incorrect or unsuccessful answers or playing attempts while using the applicable games or services for which Kicks are used. Kicks will not be reimbursed or refunded should you choose to deregister from the Service. We reserve the right to manage, regulate, control, or eliminate a Kick balance, and have no liability to you or any third party in any event that we exercise such rights. We reserve the right to amend the pricing for Kicks.

    6. Where subscription applies to a premium service, you may unsubscribe at any time, while still remaining registered for the Service.

    7. Premium services relating to the following of a specific team may only be received for teams and tournaments being covered by the Service at the relevant points in time.

      1. For local South African soccer, alerts may only be received for one of the South African PSL football clubs playing in the current season’s campaign. Only one team can be selected and followed at a time. The chosen team applies for the entire season may only be changed at the commencement of a new season.

      2. Alerts are only generated and sent for official South African domestic competitions, including the PSL, Nedbank Cup, MTN8, Telkom Knockout fixtures and any other official domestic competitions as arranged by the South African football authorities. You acknowledge that the composition and structure of these tournaments is outside of Vodacom’s control and you indemnify Vodacom from any inconvenience caused by this.

    8. You acknowledge that the premium services relating to match events (team line-ups, halftime summary and fulltime summary and other related messages) are delivered in real-time and depending on fixture timing, may be delivered at times outside of 7h00-20h00, with the intention of aligning as close as possible to the timing of the actual match events. Vodacom will not be held liable for any inconvenience caused by the sending of alerts outside of these times. Should you not be in agreement with these conditions regarding the alerts, you are advised to unsubscribe from the alerts at any time through the Service menu.

    9. You acknowledge that certain features, content and access will be bundled as part of the main premium service. This is subject to change at any time at Vodacom’s discretion. Any change in this respect will be communicated to you with at least 1 (one) month’s notice via applicable means, including but not limited to, the sending of a standard text message to your device to inform you of any applicable change.

  1. Rewards

    1. As part of the Service, Vodacom will reward Registered users who remain registered with Vodacom Soccer, and meet the conditions set out in clauses 5b-n below.

    2. Network rewards are earned only by:

      1. Users who are subscribed to the subscription based, paid for, premium text alert service which allows users to follow a team of their choosing. The earning of rewards is linked to the performance of that chosen team. You acknowledge that the rewards may only be earned by remaining subscribed to the paid for text alert service and that should you at any time exercise your option to unsubscribe from the paid for text alert service, you forfeit the ability to earn rewards via the following of your chosen team.

      2. Users who use Kicks on the Service as part of the paid games offered on the service. The top players, as ranked by points, will be rewarded on a weekly, monthly and seasonal basis. The number of players rewarded will vary based on our discretion. The points ranking (and your own ranking within it) can be viewed on the leaderboards accessible on the Service at any time.

    3. Rewards can only be earned by Vodacom customers. Any non-Vodacom customers will be unable to earn rewards due to their being active on a different network. You acknowledge that this is outside of Vodacom’s control and you indemnify Vodacom from any inconvenience caused by this.

    4. For the premium text alert service, A reward is earned when your chosen local team wins a fixture in any of the domestic competitions applicable in the local South African PSL soccer framework.

    5. For the paid games, a reward is earned based on your weekly, monthly or seasonal ranking amongst all other players based on points earned while playing the paid games. Only top ranked players are rewarded, based on their performance within the games. Players are not in any ranked or rewarded based on how many Kick purchases they incur.

    6. Rewards earned are predetermined by Vodacom to qualifying recipients. A reward can be in the form of a Vodacom Voice, SMS or Data bundle, or any other network reward that Vodacom elects to offer. When you qualify for a reward, you will receive at least two messages to inform you that you have qualified for a reward, and to indicate what the reward is. Additional messages are only sent if applicable to remind you to use the reward before its applicable expiry date if you have failed to do so.

    7. Once allocated to you, each reward may have a limited validity period and a specified time period during which it can be used. Any unused rewards will expire at the end of the validity period. Rewards are only valid for the period upon which they are allocated and can be used within the specified period. This will be communicated to you via a relevant text message before the reward is available for use. Any usage of voice, SMS or data, or other Vodacom services that falls outside the allocated day and time slot will be billed at your applicable price plan rates. If you deplete your reward during the allocated period, any additional usage voice, SMS or data, or other Vodacom service will be billed at your applicable price plan rates.

    8. A list of unused network rewards can be viewed by dialling *111# (from a Vodacom number) and following the prompts, or via the Vodacom website. Unless otherwise specified or communicated, used and unused rewards are not transferable.

    9. Should you wish to unsubscribe from rewards, you may do so by unsubscribing from the premium text alert service, or cease usage of the paid games, as these are linked together.

    10. Only the qualifying Vodacom mobile number that is registered with the Service, and subscribed to the premium text alert service, and/or making use of the paid games, can earn rewards. If you have multiple mobile numbers with Vodacom, and would like to earn rewards on each one, you will need to register each mobile number with the Service and subscribe each one to the paid for text alert service.

    11. Voice rewards apply only to Vodacom-to-Vodacom calls, and will be consumed on a per minute basis. Vodacom-to-Other Network calls will be charged at your existing price plan rate. If you have redeemed airtime discounts through the Talking Points program, please note that existing Talking Points call discounts will be applicable only after the rewards minutes bundle is depleted. All calls initiated outside a voice reward eligibility period but terminate within a reward eligibility period will be billed at your existing price plan rate for the entirety of the call. All voice calls initiated within a voice reward eligibility period but terminate out of a reward eligibility period will deplete from the reward bundle until the last minute of the gift period and the remainder of the call will be billed at your existing price plan rate.

    12. SMS bundles apply to national destinations including “SMS to email” but cannot be sent to international or premium rated destinations. An SMS is equivalent to 160 characters.

    13. Prepaid customers converting to Contract & U Choose Top Up or vice versa will not be able to retain their allocated rewards.

    14. In the event that you terminate your Vodacom contract, you accept that you forfeit the use of any unused rewards by that point as well as the earning of future rewards from that point.

    15. Vodacom reserves to right to remove the rewards programme from the Service at its discretion. In such an event, this will be communicated to registered users with reasonable notice and you will be afforded the option to unsubscribe.

    16. All other non-network rewards given to registered users as a result of their interaction with the Service are available to Vodacom subscribers only.

    17. You acknowledge that in order for Vodacom to provide non-network rewards to registered users, we may be required to arrange for the transfer of personal information to appointed 3rd parties for the for the purposes of fulfilling their obligations to provide rewards in the provision of the Service.

  1. O wnership

    1. All rights, title and interest in and to the Service including, but not limited to, any games, titles, computer code, themes, objects, stories, dialogue, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation are owned by Vodacom. Vodacom reserves all rights, including, but not limited to, all intellectual property rights or other proprietary rights, in connection with the Service.

    2. Vodacom owns, has licensed, or otherwise has rights to use, or provide all of the content that appears in the Service.

    3. “User Content” means any communications, images, sounds, and all the material, data, and information that you upload or transmit through the Service, or that other users upload or transmit, including without limitation any chat, or interaction text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, adware, spyware, worms or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will at all times be processed by Vodacom in accordance with its Privacy Policy and these Terms and Conditions , as well as the purposes of the provision of the Service. Vodacom reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) without notice for any reason or for no reason at any time.

  1. Your Obligations and Entitlements

    1. In addition to the rules set out in these Terms and Conditions, your registered use of the Service and any features allowing interaction with the Service, including but not limited to, participating in polls, submission of comments, uploading of material or any other relevant interaction feature, is subject to the following guidelines:

      1. You may not to post, transmit, link to or otherwise distribute falsehoods or misrepresentations that could damage us or any third party.

      2. You may not to post, transmit, link to or otherwise distribute any material that is unlawful, obscene, profane, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offence, give rise to civil liability, violate any law, violate the legal rights of any person (including publicity or privacy rights) or is otherwise inappropriate or would restrict or inhibit any other user from using or enjoying the Services. You may not post, transmit, link to or otherwise distribute material that exploits people under the age of 18 in a sexual or violent manner, solicits personal information from anyone under the age of 18, provides information about illegal activities, such as making or buying illegal weapons, violates someone’s privacy, or provides information relating to the creation of computer viruses or other harmful or disruptive components. You also agree not to post, transmit, link to or otherwise distribute in any way information, software or other material that infringes the intellectual property rights of any party.

      3. You may not post advertisements or solicitations of any business or commercial activity, including contests or sweepstakes. You may not submit any material that relates to or involves the transmission of unsolicited mass mailing, "spamming", "junk mail" or "chain letters".

      4. You may not impersonate or falsely suggest your association with another person, or submit materials in another person’s name.

      5. You may not reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service, or to obtain any information from the Service.

      6. You may not solicit or attempt to solicit personal information from other users of the Service or collect or post anyone’s private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.

      7. You may not attempt to gain unauthorized access to the Service, or Registered accounts using the Service, or the computers, servers, or networks connected to the Service by any means other than the user interface provided, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service.

    2. Vodacom reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms and Conditions or the Service itself. Vodacom reserves the right to take action as a result, which may include, if relevant, terminating your registration and prohibiting you from using the Service. Said termination and prohibition may occur with or without notice to you, and as a result may involve the loss of any benefits, privileges or earned items associated with your use of the Service, and Vodacom is under no obligation to compensate you for any such losses or results.

    3. You are entitled to unsubscribe from the premium services at any time and for any reason by following the “cancel” prompts available within the Service menu.

    4. You are entitled to deregister from the full Service at any time and for any reason by following the “quit” prompts available within the Service menu.

    5. Vodacom assumes no responsibility for the conduct of any user submitting any User Content, and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We cannot pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Service, you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or technology may monitor and/or record your interaction with the Service or communications (including without limitation chat text) when you are using the Service.

    6. If at any time Vodacom chooses, in its sole discretion, to moderate the Service, Vodacom nonetheless assumes no responsibility for User Content and assumes no obligation to modify or remove any inappropriate User Content. We have the right, but not the obligation, in our sole discretion to edit, refuse to post, or remove any User Content.

    7. The Service may include various forums, blogs and chat features where you can post User Content, including your observations and comments on designated topics. Vodacom cannot guarantee that other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential and/or don’t want others to use, do not post it on the Service. Vodacom shall have no responsibility to evaluate, use or compensate you for any ideas or information you may choose to submit.

    8. You are solely responsible for the information that you post on, through or in connection with the Service and that you provide to others. Vodacom may reject, refuse to post or delete any User Content for any or no reason, including, but not limited to, User Content that in the sole judgment of Vodacom violates these Terms of Service.

    9. You hereby grant to Vodacom an irrevocable, perpetual, transferable, fully paid-up, royalty-free, license (including the right to sublicense and assign to third party) and right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice, in any way, your User Content as well as all modified and derivative works thereof in connection with our provision of the Service, including marketing and promotions of the Service. You also hereby grant to Vodacom the right to authorize others to exercise any of the rights granted to Vodacom under these Terms and Conditions.

    10. You are solely responsible for your interactions with other users of the Service and any other parties with whom you interact through the Service. Vodacom reserves the right, but has no obligation, to become involved in any way with these disputes. You will fully cooperate with Vodacom to investigate any suspected unlawful, fraudulent or improper activity.

    11. If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

  1. Limitation of Liability

    1. You agree that your use of the services shall be at your sole risk. To the fullest extent permitted by law, we and our officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the services and your use thereof. We make no warranties or representations about the accuracy or completeness of the services’ content or the content of any websites or services linked to these services and assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage of any nature whatsoever resulting from your access to and use of the services; (iii) any unauthorized access to or use of our servers and/or any and all personal information and/or financial information stored therein; (iv) any interruption or cessation of transmission to or from the services; (v) any bugs, viruses, trojan horses or the like which may be transmitted to or through the services by any third party; or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the services. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the services or any hyperlinked website or featured in any banner or other advertising, and we will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.

    2. To the extent permitted by applicable law, in no event shall we or our subsidiaries and affiliates, and their respective officers, directors, owners, agents, employees, representatives and licensors be liable for any special, incidental, indirect, consequential, punitive or exemplary losses or damages whatsoever or for loss of profits (including, without limitation, damages for loss of revenue, loss of data, failure to realize expected savings, interruption of activities, or any other pecuniary or economic loss) and whether arising from breach of contract, damages (including negligence), strict liability or otherwise, arising out of the use of or inability to use these services or its content, or any product or service described or provided through the services.

    3. Save to the extent permitted by law, you agree to indemnify, defend and hold harmless Vodacom from and against any and all claims, demands, actions, liability, losses, costs and expenses (including legal fees and expenses) arising from or related to: (i) any use or alleged use of the Service by any other person, whether or not authorized by you; (ii) your breach of these Terms and Conditions, including any breach of your representations and warranties herein; and (iii) your violation of any law or (iv) your use of or inability to use the Service, the contents, any hyperlinked website, and any of the products and services made available on the Service thereof.

  1. Privacy and data protection

  1. This clause explains how we collect, use, share and protect your personal information. This clause should be read together the Vodacom’s Privacy Policy . If we update this clause and our privacy policy, we will post any changes on our website.

Collecting your personal information

  1. We can get your personal information when you use this Service. In the case of the use of the Service your personal information is collected for the purpose of being used and processed in:

    • personalising the Service to your respective preferences,

    • for the serving of appropriate, tailored advertising to you via the Service,

    • for the purpose of tracking the Service’s performance,

    • troubleshooting, data analysis, testing, research and service improvement and/or to identify any technical issues that may occur from time to time,

    • for use in devising additional enhancements or improvements to the Service, and for

    • statistical, tracking, redundancy and audit purposes.

  2. The above data will not be shared with other users of the Service. However, Vodacom may collect your information in terms of clause 9 (h) and (i) below.

  3. We may also collect information about you from other organisations, if this is appropriate. These include fraud-prevention agencies, business directories and credit reference agencies. We may also collect information about you from other companies, our business, or joint venture partners.

Understanding what you want

  1. We might also use cookies (small text files stored in your browser) and other techniques such as web beacons (small, clear picture files used to follow your movements on our website). These collect information that tells us how you use our websites, web-related products and services.

  2. This, in turn, helps us make our website relevant to your interests and needs. We may use a persistent cookie (a cookie that stays linked to your browser) to record your details so we can recognise you if you visit our website again. See the next section for more details.

The personal information we collect

  1. The information we collect about you depends on the Vodacom and Vodafone products and services you use and subscribe to. It includes (but is not limited to) the following:

  1. your name, gender, , date of birth, home language, address, and email address;

  2. your preferences for particular products, services or lifestyle activities when you tell us what they are – or when we assume what they are, depending on how you use our products and services;

  3. your contact with us – such as a note or recording of a call you make to one of our contact centres, an email or letter you send to us or other records of any contact you have with us;

  4. your account information – such as phone number, handset type, handset model,, whether you are a post or prepaid customer, dates of payment owed and received, TopUp information, the subscription services you use or any other information related to your account.

  1. We will also get information on how you use our products and services, such as:

  1. the phone numbers that you call or send messages to (or the phone numbers that you receive these calls and messages from);

  2. the date, time and length of the calls and messages you send or receive through our network, and your approximate location at the time these communications take place;

  3. the level of service you receive – for example, network faults and other network events which may affect our network services;

  4. your website browsing information (which includes information about the websites you visit, and about how you use our website or other Vodafone Group websites on your mobile or a PC;

  5. the date, time and length of your internet browsing, and your approximate location at the time of browsing;

  6. your brand preference, preferred video categories, related preferences (e.g. team choice); and type of services you typically access.

Using your personal information

  1. We may use and analyse your information to:

  1. process the goods and services you have bought from us, and keep you updated with your order progress;

  2. keep you informed generally about new products and services (unless you choose not to receive our marketing messages);

  3. provide the relevant service or product to you. This includes other services not included in this terms and conditions, and services that use information about where you are when using your mobile equipment (location information) and to contact you with messages about changes to the service or product;

  4. contact you with offers or promotions based on how you use our products and services. These include your calling and messaging activities, location information and browsing information (unless you choose not to receive these messages – see below on ‘ How to opt-out’;

  5. send you targeted and relevant messages, based on your behaviour, permission and preferences. From time to time, we will send you a range of different messages, from Vodacom as well as brands, to keep you informed, or simply for you to tell us what you are into. These are not just offers and promotions but messages from your favourite brands including new products, discounts, limited offers, gifts and more. It works by using information about you to send you targeted messages relevant to you;

  6. bill you for using our products or services, or to take the appropriate amount of credit from you;

  7. respond to any questions or concerns you may have about using our network, products or services;

  8. let you know about other companies' products and services we think may interest you (including offers and discounts we’ve specially negotiated for our customers);

  9. protect our network and manage the volume of calls, texts and other use of our network. For example, we identify peak periods of use so we can try and ensure the network can handle the volume at those times

  10. understand how you use our network, products and services. That way, we can develop more interesting and relevant products and services, as well as personalising the products and services we offer you;

  11. carry out research and statistical analysis including to monitor how customers use our network, products and services on an anonymous or personal basis;

  12. • prevent and detect fraud or other crimes, recover debts or trace those who owe us money;

  13. • provide aggregated reports to third parties (such reports do not contain any information which may identify you as an individual).

  1. The information we use will be your approximate location, based on the nearest mobile cell site. As a result, this will change as you move around with your mobile phone.

  2. We will store your information for as long as we have to by law. If there is no legal requirement, we will only store it for as long as we need it.

Sharing your personal information

  1. We may share information about you with:

    1. companies in the Vodacom and Vodafone Group (Vodafone Group Plc and any company or other organisation in which Vodacom owns more than 15% of the share capital);

    2. partners or agents involved in delivering the Services;

    3. companies who are engaged to perform Service for, on behalf of Vodacom (Pty) Ltd including Vodafone Limited, or the Vodafone Group;

    4. where applicable, credit reference, fraud prevention or business scoring agencies, or other credit scoring agencies;

    5. debt collection agencies or other debt recovery organisations;

    6. law enforcement agencies, regulatory organisations, courts or other public authorities if we have to, or are authorised to by law;

    7. emergency services (if you make an emergency call), including your approximate location.

  1. We will release information if it’s reasonable for the purpose of protecting us against fraud, defending our rights or property, or to protect the interests of our customers.

  2. If we are reorganised or sold to another organisation, we may transfer any personal information we hold about you to that organisation.

  3. We may need to transfer your information to other group companies or service providers in countries outside South Africa. This may happen if our servers or suppliers and service providers are based outside South Africa, or if you use our services and products while visiting countries outside this area.

  4. At your option, we may also share your information with partner organisations we’ve chosen carefully, so they can contact you about their products and services.

Keeping your personal information secure

  1. We have specialised security teams who constantly review and improve our measures to protect your personal information from unauthorised access, accidental loss, disclosure or destruction.

  2. If we have a contract with another organisation to provide us with services or a service on our behalf to process your personal information, we will make sure they have appropriate security measures and only process your information in the way we’ve authorised them to. These organisations will not be entitled to use your personal information for their own purposes. If necessary, our security teams will check them to make sure they meet the security requirements we have set.

  3. Communications over the internet (such as emails) are not secure unless they have been encrypted. Your communications may go through a number of countries before being delivered – as this is the nature of the internet. We cannot accept responsibility for any unauthorised access or loss of personal information that’s beyond our control.

How to opt-out

  1. To stop receiving communication from Vodacom please send the text "Stop" to 30881;

i dial *117*177#, and go to “My Profile”, “My Alerts”, “Cancel Alerts” and cancel the alerts as you prefer; or

ii. open your Vodacom Soccer App, go via the menu (top left corner) and click on “edit your profile”, “edit” and change the alert settings as you prefer.
